1. Definitions
In these general terms and conditions the following terms are understood to mean:
- Medaka.nl: Medaka Fish Farm, located in the Netherlands, registered with the Chamber of Commerce
- Customer: The natural person or legal entity that enters into an agreement with Medaka.nl
- Consumer: The customer who acts for purposes outside his trade, business or profession
- ProductsAll Medaka fish Food products And related items offered by medaka.nl

- Agreement: Any agreement between Medaka.nl and the customer
2. Applicability
2.1. These general terms and conditions apply to all offers, orders, and agreements between Medaka.nl and the customer.
2.2. By placing an order, the customer declares that they are familiar with and agree to these general terms and conditions.
2.3. Deviations from these terms and conditions are only valid if expressly agreed in writing.
2.4. Additional terms and conditions may apply to business (B2B) customers, which must be agreed in writing.
3. Offers and conclusion of agreements
3.1. All offers on the website are non-binding and subject to availability.
3.2. Medaka.nl reserves the right to change prices. Price changes will not affect orders already placed.
3.3. The agreement is concluded when Medaka.nl confirms the order by email.
3.4. Medaka.nl reserves the right to refuse or cancel orders for valid reasons (for example, if fraud is suspected or incorrect information is provided).
4. Prices and payment
4.1. All prices on the website are in euros and include VAT, unless stated otherwise.
4.2. Shipping costs are listed separately and are not included in the product price unless explicitly stated.
4.3. Payment must be made via the payment methods offered on the website.
4.4. In the event of late payment, the customer is automatically in default, and Medaka.nl is entitled to charge statutory interest.
4.5. For business customers, different payment terms may apply as described in the B2B agreement.
5. Delivery and shipping
5.1. Medaka.nl strives to ship orders within 1-2 business days of receiving payment.
5.2. Delivery time is 2-5 business days after shipment, depending on the destination and the shipping method chosen by the customer.
5.3. The risk of loss or damage passes to the customer upon delivery.
5.4. In the event of a delay In delivery, medaka.nl will notify the customer.
5.5. If delivery is not possible due to errors in the information provided by the customer, any additional shipping costs will be borne by the customer.
5.6. Deliveries will be made to the address provided by the customer. The customer is responsible for the accuracy of this address.
6. Right of withdrawal (only for consumers)
6.1. Consumers have the right to cancel the agreement within 14 days of receiving the product without giving any reason.
6.2. The right of withdrawal lapses if:
- The seal on the product has been broken and the product has been opened
- The product is perishable or has a limited shelf life
- The product is custom-made or clearly personal in nature
6.3. To exercise the right of withdrawal, the customer must notify Medaka.nl in writing (by email) within the withdrawal period.
6.4. The customer must return the product, postage paid and in its original condition, within 14 days of notification of withdrawal.
6.5. Return costs are the customer's responsibility, unless Medaka.nl agrees to contribute.
6.6. After receiving and approving the returned product, Medaka.nl will refund the paid amount within 14 days.
7. Warranty and complaints
7.1. Medaka.nl guarantees that the products meet the specifications stated on the website and are free from manufacturing defects.
7.2. Complaints about delivered products must be Reported to medaka.nl in writing within 7 days of Receipt.
7.3. In the event of justified complaints about product defects, Medaka.nl will replace the product or refund the purchase price.
7.4. The warranty expires if:
- The product has not been used in accordance with the instructions for use
- The product has been exposed to incorrect storage (moisture, extreme temperatures)
- The shelf life has expired
7.5. Medaka.nl is not liable for damage resulting from improper use of the products or damage to fish due to factors other than the food itself.
8. Liability
8.1. Medaka.nl is only liable for direct damage resulting from an attributable shortcoming.
8.2. Medaka.nl's liability is limited to the amount of the order in question, with a maximum of €500.
8.3. Medaka.nl is not liable for indirect damage, consequential damage, lost profits, or damage to fish.
8.4. Medaka.nl advises customers to always introduce food gradually and to observe the fish when using new food.
9. Intellectual property
9.1. All intellectual property rights relating to the website, products, texts, images, and formulations belong to Medaka.nl.
9.2. It is not permitted to reproduce or publish any part of the website or product information without prior written permission from Medaka.nl.
10. Privacy and data protection
10.1. Medaka.nl handles customer personal data with care in accordance with GDPR legislation.

11. Disputes
11.1. Dutch law applies to all agreements between Medaka.nl and the customer.

12. Changes
12.1. Medaka.nl reserves the right to amend these terms and conditions.

13. Final provisions
13.1. If one or more provisions of these general terms and conditions are or become void, the remaining provisions will remain in full force.
13.2. In the event of any conflict between the Dutch and any translated version of these terms and conditions, the Dutch version shall prevail.
