1. Definitions
In these terms and conditions the following terms have the following meaning:
- Medaka.nl: Medaka Fish Farm, established in the Netherlands, registered with the Dutch Chamber of Commerce
- Customer: The natural or legal person who enters into an agreement with Medaka.nl
- Consumer: The customer who acts for purposes outside their business or profession
- Products: All Medaka fish feed products and related items offered by Medaka.nl
- Website: www.medaka.nl
- Agreement: Any arrangement between Medaka.nl and the customer
2. Applicability
2.1. These terms and conditions apply to all offers, orders and agreements between Medaka.nl and the customer.
2.2. By placing an order, the customer declares to be familiar with these terms and conditions and to agree to them.
2.3. Deviations from these terms are only valid if expressly agreed in writing.
2.4. Additional terms agreed in writing may apply to business (B2B) customers.
3. Offers and formation of the agreement
3.1. All offers on the website are non-binding and subject to availability.
3.2. Medaka.nl reserves the right to change prices. Price changes do not affect orders already placed.
3.3. The agreement is formed at the moment Medaka.nl confirms the order by email.
3.4. Medaka.nl reserves the right to refuse or cancel orders for valid reasons (for example a suspicion of fraud or incorrect details).
4. Prices and payment
4.1. All prices on the website are in euros and include VAT, unless stated otherwise.
4.2. Shipping costs are stated separately and are not included in the product price, unless expressly indicated.
4.3. Payment must be made using the payment methods offered on the website.
4.4. If payment is late, the customer is automatically in default and Medaka.nl is entitled to charge statutory interest.
4.5. Different payment terms as described in the B2B agreement may apply to business customers.
5. Delivery and shipping
5.1. Medaka.nl aims to ship orders within 1-2 working days after receipt of payment.
5.2. Delivery takes 2-5 working days after shipping, depending on the destination and the shipping method chosen by the customer.
5.3. The risk of loss or damage passes to the customer at the moment of delivery.
5.4. If delivery is delayed, Medaka.nl will inform the customer.
5.5. If delivery is not possible due to errors in the details provided by the customer, any additional shipping costs are for the customer's account.
5.6. Deliveries take place at the address provided by the customer. The customer is responsible for the accuracy of this address.
6. Right of withdrawal (consumers only)
6.1. Consumers have the right to dissolve the agreement without giving a reason within 14 days of receiving the product.
6.2. The right of withdrawal lapses if:
- The product's seal has been broken and the product has been opened
- The product is perishable or has a limited shelf life
- The product is made to measure or is clearly personal in nature
6.3. To exercise the right of withdrawal, the customer must notify Medaka.nl in writing (by email) within the withdrawal period.
6.4. The customer must return the product in its original condition, postage paid, within 14 days of notifying withdrawal.
6.5. Return costs are for the customer's account, unless Medaka.nl agrees to contribute.
6.6. After receipt and approval of the returned product, Medaka.nl will refund the amount paid within 14 days.
7. Warranty and complaints
7.1. Medaka.nl guarantees that the products meet the specifications stated on the website and are free from manufacturing defects.
7.2. Complaints about delivered products must be reported to Medaka.nl in writing within 7 days of receipt.
7.3. For justified complaints about product defects, Medaka.nl will replace the product or refund the purchase price.
7.4. The warranty lapses if:
- The product has not been used in accordance with the instructions for use
- The product has been exposed to incorrect storage (moisture, extreme temperatures)
- The shelf life has expired
7.5. Medaka.nl is not liable for damage arising from incorrect use of the products or damage to fish caused by factors other than the feed itself.
8. Liability
8.1. Medaka.nl is only liable for direct damage resulting from an attributable failure.
8.2. Medaka.nl's liability is limited to the amount of the order in question, with a maximum of €500.
8.3. Medaka.nl is not liable for indirect damage, consequential damage, lost profit or damage to fish.
8.4. Medaka.nl advises customers always to introduce feed gradually and to observe the fish when using new feed.
9. Intellectual property
9.1. All intellectual property rights relating to the website, products, texts, images and wording belong to Medaka.nl.
9.2. Without prior written permission from Medaka.nl, it is not permitted to reproduce or make public any part of the website or product information.
10. Privacy and data protection
10.1. Medaka.nl handles customers' personal data carefully in accordance with the GDPR (AVG).

11. Disputes
11.1. Dutch law applies to all agreements between Medaka.nl and the customer.
11.2. Disputes will be submitted to the competent court in the district where Medaka.nl is established, unless mandatory law provides otherwise.
11.3. Consumers can use the Geschillencommissie Webwinkels (Dutch webshop disputes committeewww.sgc.nl) for dispute resolution.
12. Changes
12.1. Medaka.nl reserves the right to change these terms and conditions.
12.2. Changes will be published on the website and apply to orders placed after publication.
13. Final provisions
13.1. If one or more provisions of these terms and conditions are void or annulled, the other provisions remain in force.
13.2. In case of conflict between the Dutch version and any translated version of these terms, the Dutch version prevails.
